These Terms and Conditions ("Terms") govern your access to and use of the InstaDump mobile application, website, and related services (collectively, the "Service") provided by InstaDump ("InstaDump," "we," "us," or "our").

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Service Description

InstaDump is an iOS application that allows users to select and upload photos, receive AI-generated photo scores and rankings, edit and organize photos into a carousel or photo dump, preview music, and export or share results. The Service may also include websites, landing pages, waitlist forms, support tools, and related online services.

We may add, remove, modify, limit, suspend, or discontinue any part of the Service at any time without notice.

2. Eligibility

You must be legally capable of entering into a binding agreement in order to use the Service. The Service is not intended for children under the age of 13. You agree to comply with all applicable laws, regulations, and third-party platform rules when using the Service.

3. User Content

You retain ownership of any photos or content that you upload or submit to the Service ("User Content"). By using the Service, you grant InstaDump a limited, non-exclusive, worldwide license to host, temporarily store, copy, reproduce, transmit, process, compress, convert, analyze, rank, and display your User Content as necessary to operate, provide, maintain, improve, secure, and support the Service.

You represent and warrant that you own or control all rights necessary to your User Content and that your content and use of the Service do not violate any applicable law or the rights of any third party, including copyright, privacy, publicity, or trademark rights. You are solely responsible for your User Content and any outputs that you export or share.

4. Photo Processing and Storage

Uploaded photos may be temporarily stored in private cloud systems for processing. We intend to delete uploaded content after processing or within a reasonable retention window; however, deletion cannot be guaranteed in all circumstances and may be subject to technical, operational, or legal constraints.

Certain data, including project names, edits, selected photos, and similar usage information, may be stored locally on your device.

5. AI Features and Disclaimers

InstaDump uses AI and automated systems to analyze, score, rank, and describe photos. These outputs are subjective estimates and may be inaccurate, incomplete, inconsistent, biased, delayed, offensive, or otherwise unsuitable.

We do not guarantee that any score, ranking, recommendation, or analysis is correct or that it will improve engagement, reach, or performance on any platform. You are solely responsible for reviewing and deciding whether to rely on AI-generated outputs.

6. Third-Party Services and Integrations

The Service may rely on third-party providers for AI processing, hosting, cloud storage, databases, subscriptions, analytics, support tools, notifications, and music-related features. These third-party services are outside our control and may change, fail, or be discontinued at any time.

InstaDump is not responsible for third-party outages, API changes, content availability changes, policy changes, billing issues, or platform enforcement decisions.

7. No Affiliation with Third-Party Platforms

InstaDump is not sponsored by, endorsed by, administered by, or affiliated with Instagram, TikTok, Snapchat, Apple Music, iTunes, or similar platforms. You are responsible for complying with the terms, policies, and rules of any third-party platform when using outputs from the Service.

8. Subscriptions and Billing

InstaDump offers paid features through auto-renewing subscriptions purchased via Apple’s App Store. Subscriptions automatically renew unless canceled before the renewal date. Billing, payment processing, cancellation, and refunds are handled by Apple and are subject to Apple’s terms and policies.

You must manage and cancel your subscription through your Apple account settings. InstaDump does not control Apple’s billing systems and does not guarantee refunds. If a subscription expires, is canceled, or encounters a billing issue, access to paid features may be limited, suspended, or terminated.

9. Subscription Disclosures

Pricing, features, plans, and availability may change at any time. If free trials or promotional offers are provided, they may automatically convert into paid subscriptions unless canceled before the applicable deadline. Taxes may apply where required by law.

10. Quotas, Limits, and Fair Use

The Service may impose limits on usage, including the number of uploads, analyses, file sizes, formats, and request frequency. These limits may be tied to your subscription plan, usage patterns, or system requirements and may change at any time.

We may reject, limit, or block uploads or requests that are unsupported, oversized, malformed, duplicate, suspicious, abusive, or unsafe.

11. Permissions and Device Features

Certain features of the Service may require access to your device’s photo library, internet connection, notifications, or local storage. If required permissions are not granted or if your device does not support certain features, parts of the Service may not function properly.

12. App Identifier and Account Model

InstaDump may use an app-specific identifier to operate the Service, associate subscription status, track usage, restore state, provide support, and prevent abuse. You are responsible for maintaining access to your device and Apple account to ensure continuity and restoration where applicable.

13. Acceptable Use

You agree not to use the Service in any way that violates applicable law or third-party rights. You may not upload illegal, infringing, defamatory, abusive, or harmful content. You may not attempt to bypass system limits, interfere with the Service, reverse engineer the application, or gain unauthorized access.

We may investigate violations and suspend or terminate access where appropriate.

14. Intellectual Property

The Service, including its software, design, branding, and content, is owned by InstaDump or its licensors. You are granted a limited, revocable, non-transferable right to use the Service in accordance with these Terms. No ownership rights are transferred to you.

15. Feedback

If you provide feedback, suggestions, ideas, or feature requests, you agree that InstaDump may use them without restriction, attribution, or compensation.

16. Termination

We may suspend, restrict, or terminate your access to the Service at any time for reasons including violations of these Terms, suspected fraud, legal risk, or security concerns. You may stop using the Service at any time. Certain provisions of these Terms will survive termination.

17. Disclaimers

The Service is provided on an "as is" and "as available" basis. We disclaim all warranties to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, non-infringement, and reliability. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

18. Limitation of Liability

To the fullest extent permitted by law, InstaDump is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, or goodwill. Our total liability for any claim is limited to the amount you paid to InstaDump in the twelve months preceding the claim.

19. Indemnity

You agree to indemnify, defend, and hold harmless InstaDump and its affiliates from any claims, liabilities, damages, losses, and expenses arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.

20. Privacy

Your use of the Service is also subject to our Privacy Policy.

21. Apple App Store Terms

This agreement is between you and InstaDump, not Apple. Apple is not responsible for the Service and has no obligation to provide maintenance or support. Apple is not responsible for any claims related to the app, including product liability, legal compliance, or intellectual property claims.

You agree to comply with applicable third-party terms. You represent that you are not located in a restricted jurisdiction or on any prohibited-party list under applicable law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

22. Governing Law and Disputes

These Terms are governed by the laws applicable in the country or region where the Service provider is established, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by the courts or, where permitted and agreed, through binding arbitration in a jurisdiction determined by the Service provider, unless otherwise required by applicable consumer protection law. To the extent permitted by applicable law, you waive any right to participate in a class action, class arbitration, or other representative proceeding.

23. General Terms

These Terms constitute the entire agreement between you and InstaDump. If any provision is found to be invalid, the remaining provisions will remain in effect. We may update these Terms at any time, and continued use of the Service constitutes acceptance of the updated Terms. We are not responsible for delays or failures caused by events beyond our control.
